Employment Based Residence

Individuals applying for the green card can obtain permanent residence through employment. The process involved requires input from both the green card applicant and their employer. While this process can be complicated and confusing, the new Permanent Electronic Records Management (PERM) system adopted by the Department of Labor substantially reduces the amount of time necessary for consideration and adjudication of the labor certification.

In most instances, the employer must test the US labor market to see if qualified workers are available to perform the specific jobs. Under PERM, the process of testing the labor market can be accomplished in about four to five months.

In certain cases, the immigrant may apply for permanent residency without testing the labor market. This occurs when the immigrant is either an executive or manager of a multinational company, aliens of extraordinary ability in the arts, sciences, education or business, outstanding professors and researchers and aliens of exceptional abilities and whose talents are in the national interest of the United States.
